Despite the coronavirus pandemic, North Korea continues to carry out weapons testing and to declare that not a single COVID-19 patient has emerged in the country. Analysts and medical experts, however, are highly skeptical of Pyongyang’s claims. A coronavirus outbreak would overwhelm the North’s weak healthcare system and would be devastating to its people, who suffer from relatively high levels of malnutrition and have no access to information about the pandemic.   

North Korea is one of the worst human rights violators in modern history. In February 2014, the United Nations Human Rights Council published the landmark Report of the Commission of Inquiry (COI) on Human Rights in the Democratic People’s Republic of Korea, a comprehensive account of human rights abuses committed by the authoritarian country’s leadership against its people. It was seen as a major milestone in the effort to shine a light on the gravity and scope of the problem and to hold the perpetrators accountable by bringing them before the International Criminal Court for crimes against humanity.

Over the past three years, however, the momentum for action on the report’s recommendations has faded and the human rights issue has been largely viewed as less serious a concern than the regional and global security threat posed by the North Korean nuclear program and long-range missiles.

Coinciding with the sixth anniversary of the COI report, it was the goal of the Korea Program’s twelfth annual Koret Workshop to regenerate awareness of the role of human rights in policy toward North Korea by gathering experts at Stanford to discuss the topic and generate concrete recommendations for action. In this post, we share highlights from select presentations prepared for this workshop that was canceled due to the COVID-19 crisis.

Human Rights and Denuclearization

As the Trump administration shifted from a “war of words” with North Korean leader Kim Jong Un to prioritizing summit diplomacy, the focus on the human rights problem receded and many stakeholders, both within and outside the administration, preferred to play it down so as not to jeopardize the negotiation over a denuclearization agreement.

Yet the irony, argues Asian affairs and security expert Victor Cha, is that the denuclearization and human rights agendas are inextricably intertwined. “Human rights is an integral and unavoidable component of a comprehensive North Korea strategy,” he says. Cha, professor of government and holder of the D.S. Song-KF Chair in Government and International Affairs at Georgetown University, joined APARC as the Koret Fellow in Korean Studies for the winter quarter of 2020.

Cha notes that revenues gained from forced labor exports and other human rights abuses help the Kim regime finance its proliferation activities. Furthermore, improvements in the country’s human rights condition would reflect the leadership’s commitment to reform and make a denuclearization commitment by the DPRK more credible. The United States, claims Cha, must take actionable steps to include the human rights issue in bilateral relations with Pyongyang: establish a rights-first approach in future negotiations, resume humanitarian assistance, and fill the position of a Special Envoy for Human Rights as mandated by the Congress.

Tae-Ung Baik, professor of Law and director of the Center for Korean Studies at the University of Hawaii at Manoa, calls for a step-by-step approach, advancing small, concrete changes that will have a cumulative effect toward better protection of the rights of the people of North Korea. For example, cooperation and consultation on human rights protection should be exerted to promote reform in specific areas such as the North Korean judicial and criminal justice systems.

Ambassador Robert King, who served as a special envoy for North Korean human rights issues at the U.S. Department of State in the Obama administration, also stresses that addressing the human rights problem is essential to making progress toward denuclearization and security goals. King argues that North Korea must accept international norms and standards for denuclearization, but its acceptance of international human rights standards is necessary if it is to win international legitimacy.

Freedom of Information

Although the human rights condition in North Korea has not improved, the information landscape in the country has changed significantly over the past quarter-century. Nat Kretchun, deputy director of the Open Technology Fund, describes the transformation as “trending up from an extremely low base toward greater openness and access before, more recently, retrenching.”

In the years following the famine of the mid-1990s, information flowed into the country like never before, exposing North Korean citizens to a range of new content via an array of non-networked technologies, including information from China, South Korean entertainment media, radio broadcasts from NGOs, and outside broadcasts by Voice of America and Radio Free Asia. As they regained some measure of economic stability, however, the North Korean authorities began to reestablish control over information flows. The recent available data demonstrates that access to information is falling off and the era of more socially normalized consumption of outside information is over, says Kretchun. “The government has begun implementing a far more technologically savvy information control strategy than it previously had the capacity to do […in an] effort to move communications and media consumption onto state-controlled networks via state-controlled devices.”

Indeed, Martyn Williams, a veteran watcher of North Korea’s information technology sector, shows that, while the digitization of media was the catalyst that led to the mass spread of foreign content across the country, so too has the same technology been employed to help the government combat it. For example, every Android tablet and smartphone in North Korea logs every page a person visits with the web browser and randomly takes screenshots during his/her use of the device. Users are allowed to see this database of collected screenshots but cannot delete them. “The system is sinister in its simplicity. It reminds users that everything they do on the device can be recorded and later viewed by officials […] it insidiously forces North Koreans to self-censor in fear of a device check that might never happen.”

Furthermore, the security software pre-loaded onto North Korean phones and computers cannot be replaced and the state’s digital certificate system makes mobile devices little more than consumption tools for state propaganda and personal memories. “While digital technology has created new pathways for foreign content, the increased networking of products could work against information freedom and eventually lead to the creation of an even more Orwellian society,” concludes Williams.

Minjung Kim, director of the South Korean NGO Save North Korea, emphasizes that a key to addressing the human rights problem in the country lies in discrediting the regime’s ideology in the minds of the North Korean people. It is, therefore, necessary to further produce and deliver content that educates citizens on how the regime shapes and manipulates ideology.

The Role of the United Nations

The Kim Jong Un regime responded to the 2014 COI report with outrage and denunciation, and Pyongyang has continued to refuse to cooperate with UN Special Rapporteurs.

For three consecutive years following the publication of the report, the UN Security Council returned to consider the North Korean human rights record. Since 2018, however, the issue has not been placed back on the Security Council agenda, while the U.S.-DPRK summit denuclearization diplomacy has not included a single statement regarding improving the lives of North Korea’s people.

The North Korean human rights problem has long been subject to political debates. Still, claims Joon Oh, former ambassador of South Korea to the UN and former president of the UN Economic and Social Council, future efforts can focus on helping the North Korean people realize economic and social rights, as these do not necessitate political reforms that threaten the regime. The challenge here, though, Oh recognizes, is that such efforts require technical cooperation and humanitarian assistance, which, in turn, have been narrowed down since the UN security council imposed sanctions on North Korea in 2017 for its nuclear and ballistic missile development.

Former Justice of the High Court of Australia Michael Kirby, the chair of the COI report, who has argued that there will never be peace on the Korean peninsula as long as there are grave human rights abuses occurring in North Korea, claims that “When a state is unwilling or unable to halt or avert [mass atrocity crimes], the wider international community has a collective responsibility to take whatever action is necessary. […] It is not acceptable simply to wring our hands and cry ‘never again.’ Action must be taken, however difficult and even dangerous is the path of pursuing such action can sometimes be.”

Granted, the international community must urgently reduce and eliminate the dangers posed by North Korea’s nuclear weapons and intercontinental missiles. However, says Kirby, turning a blind eye to human rights crimes because their mention will upset those who are alleged to have committed them or permitted them to be committed in their name is neither a rational nor a just response.

Kirby urges the international community to engage the large population of North Korean refugees within South Korea and to learn from their experience about the needs of the North Korean people. "Imagination and new strategies are sorely needed," he concludes. "But releasing the pressure of sanctions without assured dividends in the observance of human rights, dismantling of weaponry and achievement of security is not the way to go."

North Korea continues to declare that it has not had a single case of COVID-19, but health experts find it inconceivable that the infectious disease would not be in the country given its proximity to China and South Korea, two early victims of the pandemic. A coronavirus outbreak in the North could be devastating, says Asian affairs and security expert Victor Cha, as it would act on an extremely vulnerable population with already-compromised immune systems and outdated health care infrastructure.

Cha, professor of government and holder of the D.S. Song-KF Chair in Government and International Affairs at Georgetown University, has joined Shorenstein APARC as the Koret Fellow in Korean Studies for the winter quarter of 2020. He spoke with APARC via videoconferencing about the threat of COVID-19 to North Korea, the deadlock in the diplomacy of denuclearization, and the North Korean human rights problem.

COVID-19 or not, the Kim regime has recently stepped up again its weapons testing. The North typically resorts to missile tests, notes Cha, in periods of non-dialogue with the United States, and the data also shows that North Korea will bolster weapons testing before and after U.S. presidential elections.

What is to be done about engagement with the North? Cha believes that any new U.S. administration should prioritize three areas: first, focus not only on North Korea’s nuclear program but also on its ballistic missile delivery capability; second, enable the flow of humanitarian assistance into the country; and third, genuinely work with our allies and partners in the region, “who have tended to be neglected lately and seen in largely transactional terms.”

While at Stanford, Cha has been researching a project that he calls “Binary Choices” and that examines how U.S. allies and partners in Asia react when they are forced to choose between the United States and China over various issues. Regardless of how one feels about the U.S.-China trade war, Cha concludes, the question is if we are “calculating the other externalities, in terms of how our allies make choices, into our net assessment of whether a policy towards China is working or not.”

Truth to Power, the first-ever history of the U.S. National Intelligence Council (NIC), is told through the reflections of its eight Chairs in the period from the end of the Cold War until 2017. Co-editors Robert Hutchings and Gregory Treverton add a substantial introduction placing the NIC in its historical context going all the way back to the Board of National Estimates in the 1940s, as well as a concluding chapter that highlights key themes and judgments.

APARC Fellow Thomas Fingar, who chaired the NIC from 2005 to 2008, is one of the contributors to the book. In his chapter “New Mission, New Challenges”, Fingar discusses some of the challenges during his service with the agency. In particular, he reflects on two specific obstacles he faced during his tenure: executing the intelligence reforms drafted in the wake of 9/11, and repairing damage done to the NIC’s credibility by the failures of the National Intelligence Estimate (NIE) on Iraqi weapons of mass destruction (WMD).

Formed in 1979, the National Intelligence Council (NIC) works to provide policymakers with the U.S. intelligence community’s best judgments on crucial international issues. As a locus for coordinated intelligence analysis, the NIC’s work reflects the coordinated judgments of multiple agencies and departments in the broader intelligence community. But while it may be less shrouded in secrecy than many other intelligence offices, in some respects it is less well known.

In Truth to Power, published by Oxford University Press, editors Robert Hitchings and Gregory Treverton shed light on this little-understood intelligence agency. The volume provides the first-ever history of the NIC as recounted through the reflections of its eight chairs in the period from the end of the Cold War until 2017. APARC Fellow Thomas Fingar, who chaired the NIC from 2005 to 2008, is one of the contributors to the book.

In his chapter “New Mission, New Challenges”, Fingar discusses some of the challenges during his service with the agency. In particular, he reflects on two specific obstacles he faced during his tenure: executing the intelligence reforms drafted in the wake of 9/11, and repairing damage done to the NIC’s credibility by the failures of the National Intelligence Estimate (NIE) on Iraqi weapons of mass destruction (WMD).

During his tenure, Fingar wore not one but two hats; along with the NIC chairmanship, he concurrently served as deputy director of national intelligence for analysis (DDNI/A). He describes actions taken not only to restore confidence in the intelligence community, but also to effectively execute its expanded brief. For instance, having national intelligence officers take the DDNI’s seat at meetings afforded senior officials the opportunity to perceive their value and thereby rebuild confidence in the broader intelligence community.

The Council’s reforms would soon be put to the test by way of the production of an NIE on Iranian WMD. Fingar recognized that the estimate would be a strong indicator of whether the NIC had learned its lessons following the flawed 2002 Iraq WMD estimate, and that policymakers were certain to finely examine the end product for flaws (whether made unintentionally or with political purposes in mind). As such, Fingar needed to produce an NIE that was accurate, timely, and non-political, all while handling and incorporating newly received intelligence. Through the Iran NIE, Fingar found an opportunity to redress the often-fraught relationship between Congress and the intelligence community.

Fingar closes with a review of the NIC’s pathbreaking work in the area of climate change. At the behest of a U.S. senator, the NIC took on the task of producing an NIE on the strategic implications of climate change. The resulting study categorized countries according to both their vulnerabilities and ability to manage impacts, as well as the broader implications it had for U.S. national security over the next twenty years. And while policymakers ultimately did not use the report as Fingar had hoped, he takes justified comfort in pointing out how it laid the groundwork for additional reports that followed, such as the National Research Council’s 2013 report Climate Change and Social Stress: Implications for Security Analysis.

Following the abrupt ending of the highly anticipated second bilateral summit between President Donald Trump and North Korean leader Kim Jong-un in Hanoi, APARC and CISAC scholars evaluate the result of the summit, its implications for regional relations in Northeast Asia, and the opportunities moving forward towards the goal of denuclearization of the Korean peninsula.

This Q&A with Noa Ronkin features Andray Abrahamian, the 2018-19 Koret Fellow in Korean Studies at APARC, whose work with the nonprofit Choson Exchange has taken him to the DPRK nearly 30 times; Siegfried S. Hecker, top nuclear security expert, former Director of the Los Alamos National Laboratory, Research Professor of Management Science and Engineering, Emeritus, and Senior Fellow at CISAC/FSI, Emeritus; and Gi-Wook Shin, Professor of Sociology, William J. Perry Professor of Contemporary Korea, Director of APARC, and founding Director of the Korea Program.

Q: What is your assessment of the summit outcome? Considering Trump's decision to end the summit early, do you support that “no deal is better than a bad deal?” Do you think the summit would have been better off with even a small deal just significant enough to keep the momentum going? 
 
Abrahamian: It's a disappointment, but we don't know yet if it is a catastrophe. I think that, ideally, once it was clear that both sides were escalating towards a grand bargain no one was ready for, the U.S. and DPRK teams could have taken a break and reconvened to attempt something less ambitious. For both sides it is better domestically to go back and be able to look tough rather than concede too much, but I do wonder why there was no intermediary position available between no deal and something too big.
 
Hecker: I am disappointed, but still optimistic. Disappointed because the opportunity to take concrete steps toward denuclearization and normalization was missed. Optimistic, because Trump and Kim did not return to the ‘fire and fury’ days of 2017. They left Hanoi on good terms. I don’t believe it was a question of bad deal or no deal. Rather, it appears the two sides were actually quite close to taking important steps, but couldn’t quite get there this time. It is not clear whether time just ran out or if President Trump’s challenge to Kim Jong-un to “go bigger” moved the goal posts at the last minute. 
 
Shin: Trump made the right move. No deal is better than a small or pointless deal that could hamper future negotiations. His decision sent a warning signal to North Korea that he wouldn’t let the country continue to set the tone and pace for the negotiations. Also, he gained more domestic political slack than the alternative would have gained him. The misfortune in Hanoi may impart a new, different kind of momentum to what is destined to be a fluctuating, arduous diplomatic process.
 
Q: So what's next? What do you expect from the US and DPRK given this new dynamic? What do you think needs to be done at the working level and at the leadership level? And what do you think will be the biggest hurdle in future negotiations? 
 
Abrahamian: Both sides carefully left future talks open through their statements after the summit. If one is searching for a positive outcome, it's that the leaders perhaps now realize that much, much more will have to be agreed upon before they meet again. This should help empower working-level talks. But time is short: a U.S. election looms next year and Donald Trump faces political challenges at home. This was a missed opportunity to consolidate a relationship-building process.
 
Hecker: The American and North Korean statements following the summit paint different pictures of the final bargaining positions, but both were positive and committed to return to the bargaining table. These differences should be surmountable at the bargaining table, but it will take time and a more concerted effort. So long as North Korea ends nuclear and missile testing, we have time to come to a proper compromise, but it must clearly involve some sanctions relief for the North Korean economy. One of the biggest hurdles on the American side is to overcome internal political divisions.
 
Shin: A return to hostility is unlikely. Both sides have refrained from escalating tension and are still committed to a diplomatic solution. The negotiations will resume. The Hanoi summit served as an opportunity for a much-needed reality check, for both sides, of the lingering divergences. The biggest hurdle continues to be how to define the terms and scope of denuclearization and the U.S. corresponding measures (simultaneous and parallel actions). Now that the discrepancies have become more apparent and starker, the working-level discussions need to agree on basic yet fundamental concepts and principles, while Trump and Kim should continue the process of trust-building; confidence and trust are a must in a top-down setting.
 
Q: Are there some roles that other key players can play, such as South Korea and China? Are there any impacts of this outcome on regional relations in Northeast Asia, such as inter-Korean and China-DPRK relations? 
 
Abrahamian: Perhaps South Korea can play a bridging role again, the way it did before the Singapore summit, when Trump "pre-emptively pulled out." In that case, President Moon's intervention helped get things back on track. It is unclear if he has the political capital with either side to make that happen again, but I suspect he will try. The collapse impacts a Kim Jong-un visit to Seoul, as now it would seem to be pressure on the US, rather than operating in space the US created. China is relatively marginalized, but happy to see no secondary sanctions threats or additional testing of missiles. Japan is perhaps the most pleased of all, given how isolated it has become on North Korea issues.
 
Hecker: The Moon Jae-in administration was hoping for a more positive outcome to allow it to promote economic cooperation with the North, which I consider to be one of the most important elements of achieving a peaceful Korean Peninsula. The Hanoi outcome may require an intensified North-South dialogue to assist the North-U.S. deliberations. I am not sure how all of this will affect China-DPRK relations. I would have preferred an outcome that allows DPRK to move closer to South Korea through some sanctions relief, than to have it depend more on China through continued maximum pressure. 
 
Shin: The outcome is clearly a major setback for South Korea, as it was anticipating progress on core issues that could jumpstart inter-Korean projects. It also became unclear whether Kim would make the planned visit to Seoul anytime soon. At the same time, this might be a perfect time for South Korea to play a meaningful role. So far, the country has been seen as advocating North Korea’s position with regards to an end-of-war declaration and to a lifting or easing of sanctions. This time around, President Moon needs to convince Chairman Kim that North Korea’s bold move toward denuclearization cannot be delayed if he wishes not to lose this rare opportunity with a U.S. president who is eager to make a “big” deal.

The failure of high-level discussions may force Washington and Pyongyang to start more effective working-level talks.

HANOI—On Thursday afternoon, as it became clear that lunch between North Korean leader Kim Jong Un and U.S. President Donald Trump was off and that there would be no signing of an agreement between their two countries, storm clouds briefly gathered over Hoan Kiem Lake in Hanoi.
 
In the nearby Metropole hotel, the mood had darkened as well. The summit between the leaders was supposed to kick off a process of some form of denuclearization, through which the two countries would try to build a better relationship. Eventually, the sides hoped, zero-sum “I win, you lose” politics would be replaced by win-win cooperation. 
 
But the United States and North Korea couldn’t agree on the value of the Yongbyon nuclear complex. In a press conference that took the place of the scheduled lunch and signing, Trump said the North Koreans had wanted all sanctions lifted in return for the closure of Yongbyon. At midnight, North Korea’s Foreign Minister Ri Yong Ho contradicted the U.S. president, saying that his team had only sought some sanctions relief as per five articles adopted by the United Nations Security Council in 2016 and 2017. A Trump administration official later confirmed that Ri’s description was more accurate. Regardless, the two sides couldn’t agree on the core issue, and the summit was abruptly adjourned.

What does it take to make progress on the denuclearization of the Korean Peninsula? Five FSI scholars offer their perspective.

Looking back at 2018, we judge the first Trump-Kim summit in Singapore to have been a step in the right direction and bought time and space for diplomacy. But since the first summit, little progress has been made toward new relations and a peace regime in part because the Trump administration continues to insist on maximum pressure and sanctions until North Korea denuclearizes, in contrast with Pyongyang’s insistence on a step-by-step process requiring corresponding U.S. actions. At the same time, North Korea has not denuclearized, but it has halted key elements of what was a rapidly expanding nuclear and missile program in 2017. This halt represents an important step in the right direction as explained in our recent update on North Korea’s nuclear history, which examines the trade-offs and interplay between key components of the nuclear program. Our findings show that North Korea has been expanding its bomb fuel inventory, allowing it to potentially increase the size of its arsenal. But the end of nuclear and missile testing has reduced the overall threat posed by the North’s arsenal, significantly limiting the potential sophistication, destructive power and reach of the arsenal by impairing the North’s ambitions for hydrogen bombs and nuclear-tipped intercontinental ballistic missiles, both of which are still very much in the developmental stage. At the upcoming summit Washington should push to further reduce the threat posed by North Korea’s arsenal. A key goal is to lock in the end of nuclear and missile testing and have North Korea agree to end the production of bomb fuel in a verifiable manner. Clearly, this will require Washington to move decisively toward normalization, with some form of sanction relief.

The leaders of the United States and North Korea should use the Vietnam summit as an opportunity to minimize existing ambiguities and divergences in central questions, before they can make any meaningful progress toward denuclearization and whatever measures for the progress of denuclearization. The most basic yet urgent task is to come to a shared understanding of what denuclearization would entail. The ambiguity and obscurity of the term “denuclearization” only exacerbates the skepticism about both the U.S. and North Korean commitments to denuclearization. The future of the U.S.-Republic of Korea (ROK) alliance is another critical issue that needs to be addressed, not avoided, in Hanoi. The Vietnam meeting should leave no ambiguity in its affirmation that the U.S.-ROK alliance is not to be jeopardized in the context of U.S.-DPRK (Democratic People’s Republic of Korea) rapprochement; nor is it to be used as a reward for North Korea’s denuclearization. Lastly, the Trump administration’s vision for a “more stable and peaceful, and ultimately, a more legal peace regime” in Korea will need to be explained fully to, and understood clearly by, the North Korean leadership. Whether the means used to establish this regime will be a peace treaty, a formal end to the armistice, a combination of both, or something yet unknown is an issue that needs to be discussed and agreed upon up front in order to avoid further confusions and complications. Only bold and meaningful moves that resolve these ambiguities will enable a timely, historic breakthrough on the Korean Peninsula and will add much-needed momentum to the diplomatic endeavors of all countries involved.

To hypothesize about the outcomes of the second Trump-Kim summit and what lies ahead for U.S.-North Korea relations, we should reflect on how the two leaders met in the first place. One could argue that their first meeting was somewhat accidental, an artifact of Trump’s spontaneity following a period of heightened hostility between the U.S. and North Korea. The first summit between the two leaders was historic in its own right and it put on a good show. However, there hasn’t been much progress on denuclearization since then. Despite little progress the two are meeting again, and this second meeting is no accident. After their first meeting Trump and Kim must have struck a chord. In fact, Trump mentioned that the two had “fallen in love” after receiving a “beautiful” letter from Kim last October. What triggers their mutual attraction? Certainly not their distaste for nuclear weapons. The common interest that brings the two together is their desire for development – economic development in the case of Kim Jong Un and property development in the case of Donald Trump. Of the many unconventional aspects in the Trump-Kim relationship, what I find most extraordinary is Trump’s showing of a short film on North Korea’s potential for property development during their first summit meeting. It was truly an unusual diplomatic pitch. I believe that economic and property development will be on their agenda when they meet in Hanoi. There may even be a sequel to that short film. Trump and Kim may emerge with a joint property development agenda, while deferring denuclearization to be sorted out by their diplomatic teams.

Diplomacy is essential for resolving the nuclear crisis on the Korean Peninsula, and President Trump should get credit for keeping the high-level dialogue with Kim Jong Un going. However, last year’s Singapore summit, while producing great theater, produced little of substance. North Korea has frozen its missile and nuclear testing, but its program continues to grow. In the eight months since the two leaders met in Singapore, little tangible progress has been made, and the two sides still appear very far apart on basic concepts like the meaning of “denuclearization” and the proper sequencing among nuclear steps, moves toward normalization, the signing of a peace treaty and sanctions relief. The big worry going into the summit is that it will produce either “too little” or “too much.” One fear is that President Trump will accept “too little” – that is, more diplomatic symbolism to continue the appearance of progress while North Korea takes few concrete steps to roll back its nuclear program. Another risk is that President Trump will give “too much” in exchange for North Korean actions, in particular by taking steps that weaken the alliance with South Korea or drastically downsize the U.S. military presence on the Peninsula (which Trump has never liked).

The issues dividing the United States and the DPRK are so complicated and our mutual animosity so deep that resolution will take time and require extensive negotiations to build trust and deepen understanding of one another’s concerns and objectives. The most that should be expected from the Hanoi summit is agreement – and commitment – to continue the process of engagement by instructing and empowering subordinates to meet regularly, listen carefully and seek ways to both build a better relationship and to resolve specific issues in the context of transforming the relationship from one of distrust and animosity to one that identifies mutual interests and manages issues that cannot be resolved immediately.
